Man Sentenced for Fatally Hitting, Killing St. Paul Student

A man was sentenced in the hitting and killing a 16-year-old girl outside a St. Paul High School.
Carlos Viveros-Colorado was sentenced to more than five years in prison.
He was charged with criminal vehicular homicide and criminal vehicular operation in connection with the death of Clarisse Grime.
Authorities say the incident happened July 5 outside of Harding High School, where Grime was attending summer school.
According to authorities, Viveros-Colorado was driving a SUV at excessively high speeds on Third Street when he misjudged a turn and lost control of the vehicle.
The SUV went off of the road, hit a fire hydrant and mowed over a sign before hitting both Grime and her boyfriend, 17-year-old Eduardo Vazquez-Torres.
Grime died at the scene. Vazquez-Torres, also from St. Paul, was conscious and walking following the crash. He was taken to Regions Hospital with non-life threatening injuries.
According to the criminal complaint, Viveros-Colorado spoke to police through an interpreter. He told police his foot was stuck on the accelerator at the time of the incident. He said he has a health problem related to numbness in his legs.
He said the numbness usually lasts about 15 minutes, and he has to rub his legs to get them to work.
He admitted it was dangerous for him to drive with his condition, but said he was hoping to make it home from work.

Border Patrol to stop interpreting
SEATTLE (AP) - U.S. Border Patrol agents will no longer serve as interpreters when local law enforcement agencies request language help, according to a new decree issued by the Department of Homeland Security.
The new guidance said agents should refer such requests to private services often used by government agencies.

Hundreds of thousands of officially deported aliens have refused to leave the United States. The U.S. Citizenship and Immigration Service (USCIS) estimates that more than 800,000 aliens who have been ordered removed from the country have failed to do so. Although legally barred from receiving federal benefits such as Medicaid and food stamps, one in eight are still able to do so according to an audit conducted by the Inspector General’s Office of DHS according to a December 18th story from the Washington Times. 

The federal government has a system of tracking immigrants’ status called the Systematic Alien Verification for Entitlements Program, commonly known as SAVE. This system is supposed to identify aliens who are ordered deported but have failed to do so and is shared among government agencies so they can be identified and denied benefits.

According to this study, more than twelve percent of these aliens with an order of removal were still allowed to receive federal aid. Many of these were convicted felons and still were allowed to participate even though they should have been red-flagged. SAVE is maintained by the USCIS.

Some of the aliens ordered deported were not flagged by SAVE and allowed to obtain sensitive employment in airports the Washington Times story goes on to report.

Each year hundreds of thousands of aliens are removed to their country of origin by ICE, CBP and Border Patrol. But only a small percentage of this large number are formally deported.

Pistol purchased by ATF agent found at alleged cartel crime scene in Mexico

CBS News has learned that two guns found in the area of a recent Mexican drug cartel shootout have been linked to Fast and Furious: One trafficked by a suspect in the case, and the other purchased by a federal agent.
Mexican beauty queen Susana Flores Maria Gamez and four others died in the brutal gun battle between Sinaloa cartel members and the Mexican military in November. CBS News has learned that an FN Herstal pistol recovered near the crime scene in November was originally purchased by an Alcohol, Tobacco and Firearms (ATF) manager who was faulted by the Inspector General in Operation Fast and Furious: George Gillett. Gillett was the Asst. Special Agent in Charge of ATF Phoenix when Fast and Furious began.
The Herstal pistol is nicknamed a “cop-killer” because of its designation as a “weapon of choice” for Mexican drug cartels. CBS News has learned the Inspector General planned to question Gillett today after a hastily-opened inquiry to determine how this agent’s personal weapon got into the hands of suspected cartel members.
CBS News spoke to Gillett, who is still employed at ATF. Gillett acknowledged he once owned the weapon in question, but says he sold it in Phoenix sometime last year after advertising it on the Internet. He declined to provide the name of the man who bought it, but says he went “above and beyond” what was required by law to complete the firearms transaction. That included asking the purchaser to fill out a form giving personal information and stating that he was in the U.S. legally; and checking his driver’s license, which Gillett said was issued in the U.S.

Mexican beauty queen killed in shootout

“I didn’t do anything criminal,” said Gillett, who calls himself a gun enthusiast. “I’ve been a gun collector all my life.”
He told CBS News that he ran into financial difficulties in recent years and sold some of his firearms. Gillett says the Herstal pistol may have sold for approximately $1,100.
Sen. Charles Grassley (R-Iowa) wrote a letter (PDF) to the Inspector General late today asking for an urgent investigation. Grassley included records from three of Gillett’s gun purchases, so-called Form 4473’s, and says that Gillett appears to have provided false information on them.
“Lying on a Form 4473 is a felony and can be punished by up to five years in prison,” Grassley’s letter states. The senator also points out that’s the same alleged violation that suspects in ATF’s Fast and Furious operation were arrested for. “Jaime Avila, Jr. recently plead guilty to a variety of charges” in Fast and Furious, including “for giving a false address on Form 4473.”
Form 4473’s require purchasers to list their current residential address. Gillett’s gun purchase forms incorrectly list the local ATF Phoenix office and a shopping plaza as his personal residence, according to Grassley’s letter.
Gillett did not comment on allegations about the address on the forms.
In a related development, as CBS News reported yesterday, another weapon recovered in the same area after the shootout in which the beauty queen was killed, had been trafficked by Fast and Furious suspect Uriel Patino.

Three people found shot to death at a Cleburne County trailer park were brothers of Romero Roberto Moya, later shot down by police after a chase and gunfights in which an officer was wounded, authorities said today.
The 19-month-old boy was in stable condition in the intensive care unit at Egleston Children’s Hospital in Atlanta, the chief investigator said.
Authorities said that Moya, after finishing a one-year sentence in Alabama on a cocaine trafficking charge in March was taken into custody by U.S. Immigration and Customs Enforcement. He was deported to Mexico on April 5, said Bryan Cox, an ICE public affairs officer.

Illegal alien charged with college student’s murder in Va.
On Thursday, police arrested Julio Miguel Blanco-Garcia, 27, and charged him with the murder of 19-year-old Vanessa Pham, whose body was found in Fairfax County in 2010. The young woman was stabbed to death.
Pham was last seen alive on June 27, 2010, as she left a nail salon in the Fairfax Village Shopping Center on Gallows Road.
Less than an hour later, her mutilated body was discovered in her car, only a few blocks away.
Pham who attended college in Georgia, was home for summer vacation when she was killed.
WJLA reports that investigators have linked the suspect to Pham’s murder “through forensic evidence.”
According to U.S. Immigration and Customs Enforcement (ICE) officials, Blanco-Garcia is in the country illegally from Guatemala.

Illegal alien charged with brutal assault, attempted rape in New York
On Tuesday, police in Saratoga Springs arrested Antonio Lopez-Bautista, 18, after he allegedly pulled a 67-year-old woman from her car and attempted to rape her. The attack occurred just before 4 a.m. as the victim sat waiting for husband.
Lopez-Bautista walked up behind the woman’s vehicle parked near the intersection of Congress and South Franklin Streets, opened the door and dragged her into a dark area. All the while, punching and kicking the woman, according to police.
Someone heard the woman’s cries for help and called 911.
By the time police arrived on the scene, the assailant was gone, but following a brief search, officers found the suspect hiding under some bushes.
The victim suffered cuts and bruises to her arms, face and neck. She was transported to Saratoga Hospital for treatment and later released.
Lopez-Bautista has been charged with second-degree attempted kidnapping, first-degree attempted rape, second-degree assault and criminal obstruction of breathing or blood circulation.
The Saratogian has reported that Lopez-Bautista has already been arraigned and Judge Jeffrey Wait ordered him held on $50,000 cash bail or $100,000 bond.
However, it was determined that Lopez-Bautista is in the country illegally and is currently being held at the Saratoga County Jail on an Immigration and Customs Enforcement detainer.

The attack occurred at the Palm Restaurant, located on Calle Alvaro Obregon city center.

An Army official said a group of armed men came to attack the local restaurant employees.

The mayor of Nuevo Laredo, Benjamin Galvan, presented his government report at the Cultural Center of the city, which was guarded by members of thepolice and army.

No one wanted to provide the identify of the group of assassins.

BROWNSVILLE, Texas – Held captive in one of Mexico’s most infamous prisons, Marine Veteran Jon Hammar is seen chained to a bed in a new photo sent to the family from an anonymous Mexican email account.
“His eyes look a little lost,” an emotional Olivia Hammar, his mother, told Fox News Latino. “It doesn’t look like him. I feel like my blood pressure is through the roof.”
The photo shows Hammar in solitary confinement inside the Matamoros state prison, nicknamed CEDES. A scraggly looking Hammar is seen shirtless and barefoot with a beard, jean shorts and with his feet over what appears to be grey crocs. He is sitting on an old twin-sized mattress in a room with chipped walls. A gallon of water and a refrigerator are seen to his right. Hammar is staring at the person taking the photo and does not appear to have any visible injuries.

BROWNSVILLE — A group representing more than 14,000 businessmen in northern Mexico is pleading for the release of Marine Corps veteran Jon Hammar, warning his “unfair” imprisonment for carrying an antique shotgun on his way to a surfing vacation will further devastate an already struggling tourism market.
Hammar has been locked up since August with limited communication to his family in Florida and with little hope of being released before Christmas.
News of his incarceration is playing as widely in Mexico as it is in the United States, said Gerardo Acevedo Danache, a Matamoros, Mexico, lawyer who’s vice president for the Matamoros and the state of Tamaulipas chambers of commerce.
“I believe we are the first voice inside Mexico to demand justice,” Acevedo said. “It’s bad that you promote your country, you try to get tourists, and when you get the tourists, you put them in jail,” he said.

PHOENIX (AP) — A U.S. Border Patrol agent has been arrested after authorities say he used his patrol vehicle to smuggle drugs while on duty in southwest Arizona, according to a federal complaint.

A Manhattan college student was raped and sodomized by a thug waiting in the shadows as she returned to her Chelsea apartment, The Post has learned.
NYPD detectives tracked down Juan Martinez, 33, of Elmhurst, Queens, on Monday and charged him with first-degree rape and committing a criminal sexual act, sources said.
The vicious attack occurred at 4 a.m. on Sept. 28, when the 29-year-old victim came home to her West 15th Street co-op after a night of partying and tried to open her door, sources said.
Suddenly, Martinez allegedly jumped out from a dark corner and accosted her, snarling, “We’re going to have sex the easy way or the hard way,” law-enforcement sources said.
The brute forced his way inside, threw her down and pinned her to the ground, according to a Manhattan Criminal Court complaint.
He then raped and sodomized her, court records state.
Martinez is being held on $5,000 bail at Rikers Island.
Police sources said it was the first arrest for the 5-foot-7, 205-pound Martinez. He faces up to 25 years in prison if convicted on the top charge of rape.
According to the city’s Department of Correction Web site, the Mexican-born Martinez is wanted on an immigration warrant. His next court date is Dec. 30.

A woman scheduled for a deportation hearing Thursday in Charlotte gave birth to a healthy baby boy, then, hours later, was allowed to stay in the country.

Before the hearing, about 100 people gathered for a rally outside Charlotte Immigration Court to protest what they saw as an injustice against Isaide Serrano.

More people in the workforce are claiming discrimination over their English-speaking ability or foreign accents, leading the federal government to issue guidelines to employers on when they can enforce English-only rules, federal officials said Thursday. Workplace discrimination complaints based on national origin — which often involve language ability — rose by 76 percent from 1997 to 2011, when more than 11,800 complaints were lodged with the U.S. Equal Employment Opportunity Commission. The EEOC attributes the trend to a more ethnically diverse labor force — about 45 million Americans speak a language other than English at home. Civil-rights advocates say workplace environments have grown more hostile in states enacting tough new immigration laws. …
